issar chithi

if i purchase a property and make issar chithi on 100 Rs. stamppaper by paying 30% of the total consideration. balance 70% is payable after 6 month and sale deed to be executed after that.suppose i fail to pay the balance amount on that day ,(after 6 months ))can the seller cancel the deal and forefeit my issar amount paid ? just because it is mentioned in issar chithi.pl. let me know my email address rameshgajwani@rediff.com

how to find plot no. of ancestral property in kanpur

I have recently come to know that my grand father Mr. chellaram r gajwani was allotted a house property somewhere in chamanganj kanpur after migrating from sindh pakistan in 1947 as claim settlement he has died long back my father has also died my father,s sister told me about this she wants me to find out the plot no. of that house so that we can proceed further to get possession of that house when my grand father was alive he tried alot to get the possession of the house from a muslim who was already occuping it before it was allotted to my grandfather.he didnot succeed , I donot have any document about that property or any case papers. can i get the plot no.through RTI act ? whom should i write for it ? is it possible after somany years to get back the possession pl. advise me what to do . my name Ramesh p gajwani I am from Akola (MS) my mob. no. 9850550597 my email add. rameshgajwani@rediff.com

plots sold on false POA




I purchased a plot in 2002 from owner by regd. sale deed and got ferfar and 7/12 in my name i paid NA tax of plot in 2003 and 2005 now present patwari says plot is not in my name it is in the name of some one else who purchased it from POA holder one month before me. but in his sale deed no copy of POA attached neither any registration no. of POA mentioned. my query is how 2 patwaris gave me 7/12 and recd. tax from me.present patwari says false 7/12 have been issued by 2 previous patwaris . ferfar is there but in 7/12 abstract my name has never been put.I am surprised how can 2 patwaris issue false 7/12 and collect taxes from me and why ? since3 patwaris are involved in this case I have filed an appeal before SDO for cancelling ferfar and 7/12 of other buyer and take action against patwaris and other buyer . Is it right procedure ? or should i file criminal case against seller? what should i do ? I thought to save their govt. jobs patwari will come for settlement and my problem will be solved. moreover POA holder has assured me to give plot some where else in lieu of this plot I agreed for this settlement and agreed to pay the diffrence of 2 plots which came out to be Rs. 44700/- for which he has taken 10700/- from me and given me a bayana receipt (ISSAR CHITHI) on 100/- stamp paper having accepted to receive entire amount (my old plot value and 10700/- ).but now he is not executing sale deed .I sent him legal notice but no reply in first case I have filed appeal with SDO .Hence patwaris and other buyer are pressurising him to execute my sale deed but since he has to pay money to his partner which I have paid him and adjustment money of the earlier plot , so he is delaying the sale deed . when ever I ask him to execute sale deed he just says wait for few days though he doesnot deny but he is prolonging . I am fed up. i think they donot have any power of attorney patwaris and subregistrar all are involved in this racket. now what to do in this 2 cases ? my email add. rameshgajwani@rediff.com

appeal filed before SDO

I purchased a plot by regd. sale deed in apr.2002. I got 7/12 and ferfar in 2002 from patwari, again in 2003 i paid NA tax for 2 years and recd fresh 7/12 from next patwari . I paid NA tax again in 2005. now the patwari on duty says plot is not in my name but it is someone else;s name who has purchased it one month before me from poa holder . i recd. certified copy of his sale deed there is no copy of POA attached with sale deed nor any registration no. of POA is mentioned in that sale deed .saledeed onlr mentions only name of POA holder .My lawyer says that may be they donot have POA . so we have filed appeal with SDO court. case has been admitted and notices have been issued to 3 patwaris and owner of the property and other buyer of the propertyby way of POA. first hearing is on 27/1/10. my question is - can a SDO cancel his ferfar and 7/12 if it is found that they donot have any POA. can we make sub registrar also party for registering sale deed w/o checking POA ? is it the right procedure or should I file police complaint ? my lawyers says lets us see what is the order of SDO .then we will take next step since patwaris are also involved here so we went to SDO court. my email add.-- rameshgajwani@rediff.com

seller is not executing sale deed of a plot

I purchased a plot and paid 50% amount to owner in jan. 09 he made a issar chithi (Bayana agreement) on Rs. 100 stamp paper, duly signed with 2 witnesses. wherein he mentioned that rest amount has to be paid on or before 13/7/09 and sale deed to be done. I phoned him up on 7/7/09 asking him to execute the sale deed as i was ready to pay the rest amount but he said wait for 15-20 days because he said he was not owner of the plots he was mediator/ broker or some thing. this plot was part of a lay out owned by 4 partners who had asked them to sell the plots and orally authorised him to accept bayana money from purchasers . I sent him a letter on 7/7/09 by courier requesting him to execute sale deed , again on 11/8/09 and on 16/09/09 i sent him letters through couriers but no reply on 24/10/09 i sent him regd. a/d letter warning him either execute sale deed or refund my money within 7 days he phoned me up and again told me to wait for few days and also he changed the last date of sale deed from 13/7/09 to 13/2/10 by his handwriting and signed there on original stamp paper which I am having . but the xerox copy which is with him is still showing last date for sale deed is 13/7/09 . I waited for few days then I sent him a notice through my lawyer on 10/12/09 by regd A/D giving him 7 days time to execute sale deed otherwise civil and criminal case will be filed. He has not yer replid to that notice what should i do? Should I wait till 13/2/10 or before that I can file criminal or civil case against him few days back he met on road and repeated same thing that wait for few days we will execute sale deed mean time i approached one of the 4 owners of the plts he said that your plot is reserved for you we have not sold to any body else but he told me to sort out the matter with that broker . pl. advise me my e mail add. rameshgajwani@rediff.com

can a notorised relinquishment deed be regd. after 10 years

same residential plot sold to 2 diff. persons

I directly from owner by regd. sale deed I got ferfar and 7/12 in my name in 2002 then again I got 7/12 and paid 2 years NA taxes in 2003 . again in 2005 I paid 2 years na taxes to patwari I have all original documents. now patwari says that these 2 plots are not in my name they are in somebody elses name who has purchased the plots through POA in march 2002( One month before me). I saw his regd. sale deed in which there is no copy of POA enclsed nor any registration no. of POA is mentioned in sale deed . sale deed mentions only name of POA holder. I approached POA holder and the purchaser of the plots they are not showing POA .now what should I do ? The owner says He has given POA but excluding my 2 plots.
