Dear Experts,
I am filing Suit for Partition of Flat which was purchased by my Client's deceased mother and he is demanding 1/4th of the share in flat and the possession is not with him.
My queries are:
1)Whether he will have to pay Court fees on total valuation of the Flat or 1/4th of the valuation which he is demanding?
2)If he wants to demand money by selling the Property then armaments and Prayers in Plaint will be sufficient or separate application is required?

Respected Experts,
If Guarantor for loan in Co-operative Bank in Maharashtra had to pay the loan outstanding in recovery proceedings as the Borrower is not paying the same, then in which court he can file Suit for recovery of his money against original borrower?
Can he file Dispute before Co-operative Court for recovery of money or he should file Money Suit before Civil Court?
Please Guide.

Dear Experts,
In the matter of Specific Performance of Contract upon the Application of the Defendant the Court has passed an Order that the Plaint is rejected under Order 7 rule 11 of CPC as the same is barred by the provisions of Order 2 Rule 2 of the CPC.
In the said matter the Plaintiff has also filed his Evidence.
Kindly guide that at this stage can Plaintiff request to the Court for refund of Court Fees as the amount is substantial? If yes, what will be the procedure for the same?

Under which Writ? Sections of CrPC?

Dear Experts,
If I want to file Suit for declaration for Flat as against the Vendor and other parties.
My Client had purchased the Flat in the year 2011 and now Vendor(previous owner) is absconding and has created third party interest in the title.
my Client is unable to provide Vendor's last known address as previously he was residing in the disputed Flat.
Please guide.

What is the period for filing appeal against an Order passed on Exh 5?
In the instant matter Order was passed on 16/08/2013 and application for certified copy was made on 13/09/2013 and the certified copy has been received on 19/09/2013 and appeal is to be filed on 20/09/2013 - whether the matter is under limitation or application for condonation will have to be made?

If Junior Advocate wrongly mentioned "No Objection" on the application moved by the Opposite Party in Civil Court then under which provisions the said say of "No Objection" can be rectified?
Is there any Authority available to quote?

Execution of criminal decree.
Hello Experts,
Criminal Court convicted the Accused in 138 matter.
Thereafter Accused filed Appeal before Sessions Court but the said Appeal had also dismissed 2 years ago.
Now the Complainant wants to execute the Decree of conviction.
Accused is absconding.
What should be the next step?
