A Hindu Male Died- Legal heirs are wife(widow) 2 sons 1 daughter. Hindu male having self acquired property - his life time he divide his share between one son (Gift Settelement) and daughter (family settlemnt). Now another son seek his rights . What is the legal staus ?
Y V Vishweshwar Rao (Expert) 23 December 2010
It is the Self acquired property of Hindu male - Father - during his life time he settled the property/ties ( his self acquired property) under Regd Gift /Family Settlement deeds in favour of One son & O daughter - the remaining property - if any - is to be succeeded by the legal heirs- Wife, 2-sons & Daughters - in equal share ! otherwise - they have to compromise for the remaining self acquired property of father- by giving it to other son and mother .

In the property which have been divided by gift and settlement, the other son has no rights but in case, there is other properties of deceased father, all the members of family will have equal rights.
