Home Tuition for my child within my flat

Hi, I'm a memeber of co-operative society in pune. I have appointed a dance teacher to give home tuitions to my 7yr old child and his 4 friends of similar age. the class is conducted in my class and it is twice a week between 4.30pm to 5.30pm. we do not want to disturb others so we put music at low volume and close windows during dance. all my other neighbors are not disturbed with this class except one who is secretary of the society and he and his family threatens us to close the class else they will take legal action against me. my query is that if it is not any commercial activity then why i should close it? if other neighbors are not affected then how can one member complain and can this complaining neighbor take any legal action against me. I request a quick reply. all the facts furnished in this mesg are true.

IF 'one who is secretary of the society'SERVES ANY NOTICE ON YOU TO 'CLOSE'ASK HIM TO CALL A GENERAL BODY MEETING
AND GET A RESOLUTION OF NO OBJECTION PASSED.

Hello Mr. Prabhakar Singh, thank you for your quick reply. Today itself I received a notice from the chairman and secretary of the society to close the dance class on account of noise and nuisance created by class and they mentioned in the notice that it is against society guidelines to conduct such home tutions at home. believe me, that my immediate neighbors have given me letter that they have no trouble by dance class for my child. the secretary stays below my flat. He conducted heavy furniture work in his flat last month and it had created lot of noise and nuisance by labor but we cooperated. I am going to reply to his notice, please give me more legal advice

it is better not to try legal remedies for such issues.
meet the secretary in person or through some common mediators and settle the issue.

Hello Mr.Mahendrakumar, I thank u for your reply in this regard. I also have no intention to trouble anyone or get into legal notice, but secretary seems to be in no mood to accept it and getting personal grudges. His current behavior is very surprising as we both families share cordial relations.All my immediate neighbors staying on the same floor and a floor above and below have given me NOC and declared that dance class is not creating any noise or nuisance except the secretary. I won't mind settling the issue by talking to him but then he could have done the same instead of sending notice to me. and if i do not stop him from such practice, tomorrow everyone and anyone will start filing complaint against each other and will make stop recreational activity in society or in personal flats. our society members are very sensible and we don't disturb anyone by any noise. his complaint is intentional as i did not involve his daughter in this class. I would be interested to know your reply after reading these facts

how about trying to involve her daughter also?
You will loose your peace of mind,if you proceed with the never ending legal battles.
in the end what you gain,other than a temporary boost to your "ego"
well,I am aware that,my answer may not be any help to you. I wish,someone among your so called relatives,involved in the matter for an amicable solution.

Hello Mr. Mahendrakumar, I sent a to-the point reply to notice sent to me. I made it clear in the notice that I don't want to trouble anyone, but society cannot interfere in my personal space and cannot ask me to stop my personal activity without verifying facts put up in anyone's complaint. all my other neighbors gave a letter to me that there was no noise and nuisance which i attached to my reply letter.I made it clear that giving home tuitions to child to provide any kind of education behind closed doors of flat is not against society guidelines. The other parents informed that we don't have commercial interest in it. After reading my reply, some sensible senior committee members didn't entertain his complaint and allowed me the access the clubhouse for dance class of my child and other 6 children of owners. so now the MATTER IS RESOLVED AND CLOSED. Thank you for your valuable advice
