How go gift the share of my dad's property to my brother

Hi, I would like to know what's d procedure to gift my share of my dad property to my brother

It is believed that you are Hindu.

To make gift you should be owner or must have have attained status equal to that of owner.


If your father is not alive then first of all obtain death certificate and obtain list of documents required to mutate the property in the names of CalssI legal heirs equally (Spouse,sons,daughters..................) and submit to mutate the property in the name of ClassI legal heirs.


An able lawyer specializing in property/revenue/family/civil matters can advise you and also draft a suitable gift deed for you.

If it is ancestral property then the same should be partitioned through a family settlement deed and if the shares of each of the coparcerners have been effectuated then you can gift your share to your brother.

If you have a share out of your father's property and suppose your brother is also a co-sharer, you may execute a registered release deed relinquishing your rights in his favor, this will take care of your proposed intention.
