Is carrying nunchaku illegal in india...?

(Querist) 19 July 2014 This query is : Resolved
Dear August members,
kindly share the detail on legality on carrying/possessing/practicing/travelling in Delhi metro or any other public transport with Nunchaku.
For your reference, here is the image of Nunchaku attached.
This is specifically used for Kungfu practice and self defence.
Adv.Aiyer VLV (Expert) 19 July 2014
practising in public transport will be public nuisance.

carrying inside a bag isn't offence. when carrying a knife isn't oftener, this won't be too
Punit Gupta (Querist) 20 July 2014
Respected Aiyer Sir,
Security personnel at Delhi metro asked one of my client to either throw it away in bin or don't travel at all. he was carrying it in a leather bag. They argued that we have different law. And that one was made of steel, but as per my understanding, steel made should not be a problem here. Kindly share if the weapons and arms are governed by any other law of land than Arms Act 1959.
Moreover, practicing in a park, at a secluded area should not be a problem for any, as per my understanding. Kindly share your expert wit on this.
Regards:
Punit

Nanu chaku does not come under the definition of Arms.
Ask your client to carry any certificate of paper of such training so the Police is convinced of absence of any mischief out of this.

Nunchack is not termed as an arm as per the arms act. I agree with the views and suggestions of expert Mr.Barman on further issues on the query.
Anirudh (Expert) 20 July 2014
Water bottle, shaving cream etc., are also not 'arms' as per arms act, but they are also not being allowed to be carried in the plane.

Forget about Nunchack, even one is not permitted to eat anything in the metro premises. Therefore, if that is the safety rule, better abide by it instead of trying to question each and everything. Yes, you can question, but that would be costly (with uncertain result) and time consuming. Please remember, no court is going to give you the ruling instantly, to enable you to carry the Nunchak in the metro on the same day or within a week or so.

Such item is not allowed in plains.
Punit Gupta (Querist) 21 July 2014
Dear Mr Makkad,
Thanks for your insight, but this seems an arguable hotspot where plains and hills and various other geographical establishments will determine the law on such items.
Please share your views in a bit detail.
Looking forward for your grace.
Raj Kumar Makkad (Expert) 21 July 2014
There is no separate law to deal with this item. This is legal in India hence no other point to add.
Biswanath Roy (Expert) 21 July 2014
NUN-CHAKU DOES NOT COMES UNDER THE PERVIEW OF ARMS ACT BECAUSE IT IS NOT AN WEAPON THIS IS A SELF PROTECTION DEVICE.
Advocate. Arunagiri (Expert) 21 July 2014
Nunchaku is banned in many countries. But, in India we have not framed laws for many activities, like para gliding, archery, nuchaku etc.

But, it is a weapon.
Punit Gupta (Querist) 22 July 2014
Dear Mr Makkad, Agreed with your point.
Just wondering what Plains imply here?
Thanks for your grace.

@ Learned Mr. Aunagiri,
Yes, I agree with you Nan-Chaku falls within the meaning of a weapon in as much as it is an instrument which can be used or to be used to injure a person or persons. Thanks to rectify me.
Raj Kumar Makkad (Expert) 22 July 2014
Mr. Punit! The word 'plains' imply airways. Anyway, You are satisfied with the replies of the expers.
Punit Gupta (Querist) 22 July 2014
Dear Mr. Makkad,
On a lighter node, this left me laughing as I took it as plains as in the geographical phenomenon like hills, plains and plateau and was carried away with different interpretations.
Yet again thanks for your grace.

iT WAS TYPO AND SHOULD BE SPELT AS ' PLANE'.
Punit Gupta (Querist) 23 July 2014
Yes, Mr barman, Agreed.
but this was a hilarious one for me at least and I indeed had to think for a while to understand this Plain/Plane thing in the whole topic.
Anyways, thanks for your grace.

I will just add that a nail cutter or shaving blade doe snot come under weapon but not allowed in aircraft.

matchbox or cigarette lighter is not an arm but DMRC does not allow this.

stick is not a weapon but (other than walking stick of old and disabled) is not allowed inside polling station.

Nanchaku though technically not a weapon but it is a tool which can give fatal blow.
