Legal heirs of wife would be eligible for share in her half portion of the property only.

What will be the position if one of the legal heir . . . . . a daughter has predeceased? Will her husband and child be eligible for equal shares with the others? And also what if a son has predeceased leaving behind his wife and two children? Please clarify.

Dear Mr. Khshyla,
Do not try to test us through your hypothetical questions.
Better come up with real facts and pose your query to get an appropriate answer.

Sir my mother in law expired on the 3rd Aug without any will. She and my father in law have an agri land in their joint names. They had 4 sons and 2 daughters. But now only 3 sons and 1 daughter is alive. The youngest son and daughter died 7 and 10 years before. Hence the previous doubt. In case the said land is to be sold I wanted to know who all will have to consent to the same. Sorry if my question semed hypothetical. Sorry again. Will surely seek an advocate's advice soon. Thank you.

the share of your mother in law will devolve around her legal heirs and if any legal heir is dead as in your case youngest son and daughter then the share which they were to inherit will be further given to their children or husband they survived.
