Maintainability -Daughter rights over the father property
Supreme court judgment on 24th Oct 2015 will restrict the right of women seeking equal share.
Father would have had to be alive on September 9, 2005, if the daughter were to become a co-sharer with her male siblings.
Maintainability of the case regard to cut-off date Sep 9 2005.
Any provisions to file appeal against the judgment.
PIL registered and notice issued Attorney General and National Legal Services Authority may be call on 23Nov 2015.
Please let me know the daughter right over the father self-acquired property, weather maintainable

No Legal Claim Could be Made by Children in Self Acquired Property of Parents.It is Purely at the Discretion of Concerned Parent.

If No Will is made by the Parent All their Children Would have Equal Rights In the Property irrespective of Male Or Female in Hindu Law.This Would Come in to Effect From 2005.If Parents were No More Before this Amendment the claims of daughters would be Ruled Out.

Some properties from the mother of the daughter father (Grand mother)ancestral.

The some properties are granted by INAM DC order-by cultivation to father.

Any descrimination b/w the properties cam exrcise right by HSA 1956.

The Govt of India repealed the HSA (amnd)2005 is repealed on 13th May 2015.

How the Supreme court judgment on 24th Oct 2015 used the same act for the disposing the case.
