Merciless, gruesome torture and female infanticide by senior doctors themselves.

SUB:

1. Horrible and gruesome torture and murder of an innocent female newborn baby at Aditya Hospital, Chennai, by remorseless senior doctors.

2. Intimidation and humiliation of my mum and sister by the accused and police personnel of Kilpauk police station along with getting some documents signed by them under duress.

3. Complaint of female infanticide lodged with JCP, North Chennai on 4/12/2010 closed without investigation or even an FIR, by 8/1/2011 without even asking me, the complainant, any details regarding the evidence and the several eyewitnesses of this inhuman crime.

4. Complaint (No 801/2011) filed with the SHRC TN in January, yet no response from them so far.

5. Same complaint lodged again with JCP, Central Chennai in June this year after the change of regime in TN. Again no FIR registered and no investigation done.

6. Presently contemplating about filing a criminal writ petition in the Chennai High Court to get the criminals convicted.



Respected Sir/Madam,

I had filed a complaint with Mr.T.N.Seshasai, IPS, Jt. Commissioner, North Chennai on 4/12/2010 about criminal torture and female infanticide, committed by a few very senior doctors inside the operation theater of Aditya hospital in the heart of Chennai, while I was working there as a doctor. A new born baby girl, born to an unmarried girl, who came to the hospital along with her mother, was left locked alone inside the operation theater where she was just delivered. She was left with absolutely no feeds, totally uncovered and with the umbilical cord unclamped, for over 20 hrs, expecting the baby to die soon. But she was alive, though dehydrated and cyanosed, even after one full day of such disgusting and cruel behavior of money minded doctors. As the baby was still alive, an OT assistant, Mr.Rajan took her away somewhere and disposed the baby. This crime happened 9pm, 11th through 6pm, 12th May 2010, at Aditya Hospital, no.7 Barnaby Road, Chennai.

The accused doctors being very influential used their clout in the previous DMK regime to close the case without any investigation at all. The complaint was forwarded to Ms.Lakshmi, DCP, Kilpauk on 6/12/2010. Then it was sent to Mr.Vijayaraghavan, ACP, Kilpauk for investigation. However, without any investigation at all, the case report was sent back to the Commissioner’s office on 8/1/2011 for approval and the case was closed.

The doctors and the police personnel of the Kilpauk police station had taken my innocent mother and sister to their station on 4/12/2010 morning around 11AM, while I was not at home and intimidated and harassed them and got some documents signed that I was mentally ill and that my complaint should not be taken seriously. They used these documents to close the case without any investigation.

Details regarding the case:

Ms.Sudha got admitted to the hospital on the evening of 11/5/2010. It was me who actually who filled in her case history at around 8.30pm. I was just told that she got admitted for surgical removal of some tumor in the abdomen. On further questioning, I was politely told that the gynecologist knew all the details and that I could get the details from her. I actually came to know about the horrible and disgusting truth only on the morning of 12th may, around 7.30am, while I was leaving the hospital after my duty got over. On questioning the nurses, I was told that it was being done with the consent of the hospital owners. I felt sick and miserable that I was working for them and that I could do nothing about it. By the time I came back at 8pm on 12th, I was told about the rest of the disgusting crime.

Though the crime occurred in May 2010, I did not file a complaint immediately as I thought that the doctors’ lives would be ruined and the hospital shut down immediately. Several doctors would get convicted and the reputation the medical profession had would get worse. I thought long and hard with a clear mind and decided that keeping silent would be the best option as the baby was already dead. However, as the accused doctors kept on with their unethical practices and sent police to my home to try and intimidate me and my family, I was forced to file the complaint on 4/12/2010.

The police personnel of Kilpauk police station (I reside at Annanagar, within K4 police station jurisdiction), came to my house on 4/12/2010, telling me that I was defaming the accused doctors. They were led by Mr. Subburaj, an inspector, L & O, G3 police station. As they could not intimidate me, they waited till I left for the Police Commissioner’s Office to file my complaint and then took my innocent mother and sister to the Kilpauk police station and threatened and humiliated them. They were made to sign some documents saying that I was mentally ill and that my complaint with the Police Commissioner’s Office about the crime of the doctors should not be taken seriously. They later used those documents to close the case without any investigation at all. My mum is ignorant and old fashioned, not well informed. She assumed I had committed some crime as the police came home. She got very frightened and paranoid. I had to take her to my grandmother’s place in AP and stay with her for a few days as she was already a heart patient and became almost hysterical.

When I called the commissioner's office on 6th Dec, 2010, I was told that the complaint had been forwarded to Ms.Lakshmi, DCP, Kilpauk, where the hospital is located. When I tried to contact the DCP, I was repeatedly told everyday that the DCP was not available, busy at some meeting. I had mentioned in my complaint that I had evidence and several eye witnesses to convict the guilty. Yet I was not given the opportunity to present the facts. I knew the culprits would be using all their political and financial clout to try to destroy the evidences and intimidate all the eyewitnesses. But the evidence was too strong to be hidden or destroyed. On 16th Dec, as it had already been around 12 days after I filed the complaint and as I was not contacted yet about any details that they needed, I decided to go and meet the DCP of Kilpauk. Around 1pm, I went to the DCP's office, taking along with me all the details. Firstly, I was asked why I was filing the complaint when I was not the victim. Then, I was told that if I did not like what I saw at the hospital, I should have just quit the hospital and joined some other hospital. Then as she was hurry, I was asked to go to the G3 Kilpauk police station the next morning so that the accused could discuss the issue with me and a compromise could be arrived at. Instead of proceeding with the investigation to avoid tampering of evidence, I am advised to come to a compromise and withdraw my complaint.

Dec 17th morning, I went to the G3 station. There, Mr.Vijayaraghavan, ACP, Kilpauk gave me a discourse on how I should lead my life. I was told that as I was a doctor, I should not be ruining my life and career by getting involved in such cases. He told me that I should actually be sitting at home, taking care of my sick mum, who in the first place, got sick because of the intimidation and humiliation she was made to go through by the police personnel of his own station. Interspersed with his patronizing sweet talk were veiled threats and unwanted advice about the safety of me and my mum. I could not believe that an ACP was behaving like this. On top of that, he told me that his men were standing as security in front of the hospital for the past several days. The people who were supposed to be protecting the righteous were actually providing security to the criminals accused of the most disgusting crime.

Dec 18th evening, around 6pm, I went to G3 station again to get a copy of the FIR of my complaint. But I was told by the Inspector of G3, Mrs.Rajeshwari that the FIR was not yet registered and that I would be informed when it was done. She also told me discreetly that she could get me whatever I wanted if I stopped pursuing the case and went ahead with my career. I got totally frustrated. Due to the severe stress and anxiety I had to go through, I had to be admitted to a hospital and treated for the same during the 3rd week of December. Though I was admitted to a hospital, I can assure you that I am perfectly fine and have a clear mind with sound judgment.

Then I registered a complaint with the TN State Human Rights Commission (complaint no. 801/2011). No action has been taken yet. I even wrote to the President’s secretariat helpline (complaint no. PRSEC/E/2011/01187), which was forwarded to the Special Officer, CM Special Cell. I even went and spoke to him personally. He assured me that action would be taken. But nothing was done.

After the regime in TN changed in May, I met the JCP, Central Chennai, Mr.K.Shankar and lodged the same complaint again. He too assured me that action would be taken. It was forwarded to the DCP Kilpauk for investigation. But till date nothing has been done. Even an FIR was not registered once again.

The criminal doctors have been tracing all my phone calls and bribing anyone who might help me. Criminal investigative journalist, Pushp Kumar Sharma of Tehelka was the first to be bribed. Then, Mr.Chandrashekar, Senior Associate, India Law Offices, Delhi. I don’t know how many more people they are bribing.

Now I suppose the only hope I have is to file a criminal writ petition in the Chennai High Court. If the judges of the Chennai High Court also collude with the criminals, I will even approach the Supreme court if possible. I am considering other options as well.

There are several hospital staff who are eye witnesses to the crime and ready to testify in court.

P.S. I have absolutely no intention of gaining anything out of convicting the criminals. I have got my own job and a clinic which is running well. With the amount of evidence and eyewitnesses, pleading guilty is their best option.

The remedy of ur case can be obtained from ur State High Court by filling an application under Article 226 of the constitution of India making Police authorities of the state along with the doctors liable for the criminal liabilities complaining that the police officers holding public offices are not discharging their duties in accordance to the Code of Criminal Procedure and Police Act as enjoined upon them causing thereby denial of natural justice and also caused injury to the legal, fundamental and constitutional right of a citizen.

Vikram! I salute your courage and dedication even though you are facing constant sufferings with no definite results. Had you been lodged your complaint on the same day of unfortunate incident, the result would have been otherwise.

Anyway! Either you file a writ before High Court or a criminal complaint under section 200 Cr. PC before the area Magistrate. You shall have to engage a local lawyer for his purpose.

Sir, can you suggest a trustable lawyer from Chennai. I had consulted a lawyer once but he took some bribe from the accused and sold me out. I am not able to trust anyone. Any help will be accepted with lots of gratitude.
