my dealer given me an illegal shipped laptop of HP company, and the company is not giving me the warranty of that laptop. I went to the lawyer and ask him to file a case for me.
He told me that firstly a notice is sent to the dealer and than a FIR will be filed. And than after we will file for the case in consumer court.
Now i want to know that if i will be charged for FIR also.

I too had the same issue with my HP laptop, but i fought with the company by sending around 70 e-mails and finally the company obliged, you need not need an advocate for that write to the customer care yourself and approach the hp service centre with the bill, you will need patience in the matter since the customer care will simply copy paste a standard reply, you too need to copy paste ur grievance every time they respond until they give in to ur legitimate demand.

If you have been cheated by the dealer you can approach the courts. But if you have bought it knowingly and without warranty, you cannot blame the company. The Rule of Caveat Emptor fixes the legal responsibility on you to verify about the legality of the sale and then go in for the same.

@MR. Vishal : sir i have brought my laptop last year and i called them many times and also went to the service center but they told me that "u can go to the consumer court, but we will not give any service to you."

Now i want to know that if we need to lodge the FIR or we can directly approach to the consumer court after the notice.
Which will be the better option.

If you want to proceed with cheating case you may have to go through the channels of police. Else, if you want to file a case with the consumer forum, you can directly lodge with the consumer forum.

sir as you said i can directly go to consumer court. but my lawyer told me that we will file two case against the dealer one is civil in the consumer court and second is criminal by lodging fir.
so i want to know that is he right??

GO TO CONSUMER COURT.
Time and again I appeal, those who have Advocate, and taking Legal advise should not use this Platform to cross check Advocates.
All advocates have their own way to deal, and will certainly differ.
There is no standard Legal Procedure to meet all situation.
All Advocates will certainly have different idea, different wordings, approach, and sitting here, we cannot analyse his mind.
It is undesirable to interfere or comment on any other Advocate's Job.

Better, use your own wisdom whether you want to file on case or two cases at different institutions of forum and court.
