I have filed an eviction suit against my tenant. He after that filed a criminal case saying that we have threatened him and also used various filthy languages. He also said that he have recorded all out filthy languages and they will prove that in court. Is it possible? What shall we do now?

If the tenant really has recorded you abusing him, then perhaps, he would be able prove it. In that case you shall have to engage some good lawyer who would find out flaws in recording of the voice, its value etc and try to get acquittal. But if he proves that you have really abused him, you may have to face conviction although you have filed eviction proceeding. Enimity is a double edged weapon.

The case may be 294 (b) and 506(ii) of IPC. it is very difficult to prove the 294 (b) and 506(ii) of IPC and individual witnesses are necessary. you have good defence that it is only a counter blast of tenancy case of eviction.

its merely a pressure tactics by your tenant, dont be afraid of this conduct, just fight it out.
engage a local lawyer and take appropriate defence as advised.

All told difficult to get easy eviction. No of other criminal cases possible.
People get elated due to recent SC judgments but forget they had go up in steps upto SC and all such cases major lapses in pleadings of the defendant.
If proper precutions taken from the first day eviction is not easy and landlord has to face lot of counter civil and criminal cases. TAKE CARE LAW CAN HEAL AS WELL CAN CUT.

Can I file a defamation case against my tenant? My tenant have given several false statements which I can prove through agreement papers. For that what I have to do?
