Need information on right of joint venture

Hi,

We had given out property for joint Venture to a builder in the year 2000 and the builder completed the construction in the year 2004 and as agreed and the agreement was made such that after completion of the building he would give us 41% of share of total build up area.

After the completion of the building the builder has given us 2 flats total size(2550sq ft) and the property given to him was of size(2200sq ft) and i have a strong feeling that there we should still get more from the built up area.

Kindly help me out in this as its been long time i am unaware of how can i proceed are there any way i can get to know and fight for my right legally.

Is there any agreement between you and builder? If there is an agreement then you can enforce it by demanding the remaining share.

What were you doing since last 9 years? Why have you not obtained the services of a building architect or surveyor in measurement of the entire built up area and due distribution between you and the builder and if the same has not been done, do it during these days and get the work done.

Hi Rajeev/Raj

Yes there was an agreement made between us but its and old agreement and my parents have agreed for the share and signed on it.
I was too young at that time so dint know about the share and currently i have an idea and so like to proceed with it.
It would be helpful if i could get some info on,
If there will be any validity date for the agreement and how to proceed with the case.
As its 9 years passed how can i proceed with the legal proceedings.

Better to obtain the services of a local lawyer dealing in civil side with entire documents in hand and obtain his opinion nand do as advised.

Thanks for all your previous advice,
I again need all your valuable inputs, i am planning to proceed by law now, request you to kindly advice, can i still proceed further and approach the Court for justice though it been too late.

Also request you to provide valuable inputs for the below issue as well,
I would like to approach the court for this as well,

My mom was born in a family with 5 Brothers and 5 Sisters altogether including my mom.
My Grand dad has a property total about 30000 Sq.Ft of land in which the above Joint venture was executed, my grand dad had allocated about 2400 sq.ft for all the daughters and about 4800 for 3 of his sons.
My last uncle had made a duplicate will through which he has acquired about 15000 sq.ft of land and had also entered into Joint venture agreement with the same builder, this came to light when i searching for some legal papers to proceed in the court of law for justice.
Request to provide your valuable suggestions and show me a way to get my rightful justice.
My doubt is can i or my mom approach the court for equal share of land, as we are sure that my grand dad has not made any will.
As he had sold these and made a lot of money will he be liable to pay us a share with what ever he had earned from so many years with the investment which he got from his ansisterial property.
I am really not a greedy man, i just want to teach my uncle a lesson through law, as he thinks that we cannot do anything to him and he can do anything with his money, for all the pain my family has gone through i want to approach the law and get Fair justice for what is truly ours.
