R/sir my father got some agriculture land in family distribution. After distribution mutation recorded in revenue record in name of my father till 2010. In the year 2010 land was sell out other person that was recorded in the name of next purchaser in revenue record. But the same time my cousin brother firstly file preemption suit in civil court but after some time suit is withdraw by him then after fresh suit filed for declaration & permanent injuction before civil court against my father & next purchaser. My question is can my cousin won that case on the plea "he was in possession before 12 years so he got occupancy tenant right under provision m.p land revenue code."

In my view, from the available facts given in your query, he can't get success in his claim.
However, one can opine only after going thru all the deeds and scrutinising the documents.
