In society building in Mumbai, there are earmarked guest parking where visitor can park their car. Society intends to charge visitors parking charges on hourly basis just like we may in malls, etc after taking approval from General Body. Is this doable by the Society?

Society can charge parking after passing required resolution in meetings. However it has to be reasonable comparing to other parking charges.

1. Society is a ghetto of members and all its facilities are for its own members only, which includes parking spaces. Allowing use of members facility by outsiders defeat the very purpose of registering a CHS.
2. Society not being a Commercial entity CANNOT charge parking charges to any visitors /guests. This will attract GST, Income Tax, BMC Property Taxes at commercial rates, violation of the Fire Act, the Police Act and a violation of the terms and conditons of Registration norms of the Society.
3. The above is irrespective of any resolutions passed in any GB /MC meetings or whatever.
4. The entire MC, shall be criminally liable, with imprisonment with free food and lodging, for any violation or incidents relating to visitors parking nuisances.
