Property tax unpaid

Hi,

I have purchased a Flat in navi mumbai (CIDCO) 2 months back for which property tax is unpaid from 2013 (approx. 11500/- is due), also there are maintenance charges which are not paid & the GAS connection bill is also not paid for July & August
now Seller is not ready to pay the dues.
Also I have paid the society transfer fees of 20000/- via cheque to society. which he promised to pay me once he get the cheque (Bank loan disbursment) but now he is not ready to pay any amount. this is also the part of the agreement.
What should I do?

Normally in the sale agreement, an inherent term and conditions contain that the property is free from encumbrances and liabilities.

Thus the seller has cheated you and also before purchase you should have checked the aspects of tax and maintenance charges.
As informed by learned colleague mr sudhir kumar, the seller is liable and you can sue him.

Agreed with the experts, you can send a legal notice and then sue the vendor.
