regarding repartion of divided property

Sir, my father and his 2 elder brothers did partion of my grandfather property 42 years before where my grandfather is no more..now one of elder brother felt that he had less than one person..whether he has any provision to redo partion.. for the past 40 years all taxes has been paid by their indivdual of their respective divided property..please provide suggestion Whether he has right to do repartion...

The partition cannot be reopened if the partition deed was duly executed.

Whether the document was registered?
Where the property is situated?
Who were the legal heirs?
Whether partition was done before the Grand father and when he expired?
Broadly Partition can be reopened if all parties agree to it.

The partition was effected mutually and the same has been acted upon and each individual is in possession and peaceful enjoyment of their respective shares for decades hence it may not maintainable to reopen the partition on some flimsy grounds.
