I am a Christian by birth and marriage. I and my husband intend to settle abroad and have filed for PR in Australia and eventually intend to get citizenship of Australia. We have land property in the Mumbai Suburbs. Once we are Australian citizens, 1. will we retain right to such property. 2. is there any legal way for us to know if the other co-owners of our property are trying to dispose of our property without informing us, something like a caveat.

1.yes! 2.There is no mechanism except making searches time to time in the office of sub registrar concerned.And such a search any body can make for which no authorisation letter is required as that is open to all public.

Becoming a foreign citizen does not deprive rights in Indian property. For getting information about property time to time search has to be made in Registrar office.

NRI has full power to purchase and retain the properties in India. India has also made treaty with many countries wherein the dual citizenship is available to such person who originally belg to India and they have full right to retain and purchase properties in India.
