Sale of commercial property

Querist : Anonymous (Querist) 20 June 2010 This query is : Resolved
Can existing partner sell off partnership company's property without informing legal heirs of the deceased partner.
adv. rajeev ( rajoo ) (Expert) 20 June 2010
If there is any clause in the partnership deed that after the death of one of the partners, his legal heirs will succeed him. In such cases you cannot sell the property without information to them.
B K Raghavendra Rao (Expert) 21 June 2010
Look into the partnership deed. If it has any clause about the rights and liabilities of legal heirs of a partner upon his death, then the matter would go in that way. Otherwise, legal heirs of deceased partner may have grounds to litigate the sale of company's properties without their consent.

I agree with Mr B K R Rao.
