Kindly tell , A welfare society want to runs school and hospital along with hostel .. is it possible to aquire land under land aquisition act. more over when the land is scheduled....

Dear Chandan,

No its not possible to acquired the lands under the land acquisition act. Under land acquisition act only government has the authority to acquire.

If society can acquired that properties for the above said purpose, there is no prohibition under law.

The land can be acquired through Government.The Govt has powers to acquire land for private party.

Mr. Palnitkar is right. You have to approach the Government to acquire the land for the society.

On Your Application to Govt , the Govt will Considere Your Purpose , on satisfaction , the Govt will Contribute a sum of Rs;- 100-00 towards its Govt Contribtion for the aims and objects and require you to pay the balnce Award Compensation as per the LAo

Accordingly the Land can be acquired by Your Welfare Society through Govt under Land acquisition Act !

For Valid Acquition of land in India this belowmentioned will be required:-

1. It should be for Public Purpose;
2. Application of Land Acquisition stating the facts showing public purpose;
3. Notification issued under Section 4 of the Land Acquisition Act, 1894 (the Act);
4. Declaration Under Section 6 of the Act published in the official Gazette;
5. Award issued by Collector;
