share of wife in property

(Querist) 18 October 2015 This query is : Resolved
Respected sir
My divorce case is running in court. My husband doesn't include my name in any of his property papers. So, can I include my name in is property like his house, inherited farms.
adv. rajeev ( rajoo ) (Expert) 19 October 2015
During the life time of the husband you cannot claim any share in the share of the husband( hindu law), if you have got kids along with your kids share you can claim your share by filing a suit for partition in the ancestral property of your husband

NOTHING UNDERSTOOD ACTUALLY WHAT DO YOU MEAN.
alexander (Expert) 19 October 2015
How do you propose to include your name in his properties. You must be having full details of his self acquired and inherited properties.

2. Since your case is already pending in the competent court, you must be getting (under Crpc 125):
,
(a) maintenance including medical expences for your self and the kids if any,
(b) rent for a separated accomodation befitting your dignified status
(c0 Cost of legal and related expenses for contesting / defending the suit including the Advocate's fees.

you must have already engaged an advocate for the case.

you may get good legal help from this forum onlyif you furnish all details in a succinct manner and highlighting the points on which you require clarification/assistance - as has also been pointed out by this Forum's expert Advocate Shri Sudhir Kumar ji
