Subdivision of my land

We have combined patta with my father and paternal uncle name.. Both are dead.we have patta issued In1991& no mother document etc. We want to subdivide this land with my paternal uncle family.in tahsildar office they are asking documents to divide this land.we have only patta. I need clarification either document required are any other possibilities are there?

You shall divide the property by means and bounds with mutual agreement and get it registered in Sub Registrar Office concerned. If the S.No. is not mentioned in the patta, first, obtain the survey number for the patta from the Tahsildar office.

We asked in sub register office but they are asking 1:7 for registration fees. But I don't know this come from family or non family division.if this family division, it will cost around 1:1 fees.how much registration fees will cost? Please reply.

In which state? The stamp duties and registration fees vary from one state to another state. In some states issued orders for partition/gift/settlement/release between the family members for some exemption and for other than family members. In your case, you and your uncle will not come under the family definition.

This is a jointly owned proeprty between two brothers. Now upon the death of both the brothers, the property shall automatically devolve on the legal heirs of respective brothers equally.
In the given situation, the legal heirs from both the sides can amicably divide the properties into two shares and draw a partition deed in writing, get it executed before the concerned registrar by a registered document. Since this is a partition of the family proeprty the stamp duty shall be applicable accordingly.
