Querist : Anonymous (Querist) 09 January 2012 This query is : Resolved
Dear Sirs

In case father expired with out writing his will what are the formalities to be completed to transfer the assets to name of his son

Thanks in advance
prabhakar singh (Expert) 09 January 2012
For movables like debt securities and deposits with bank etc. a SUCCESSION CERTIFICATE FROM CIVIL COURT.
For immovable an application with affidavit before municipality /revenue authority ec.,as the case may be,for MUTATION SHOWING HEIR-SHIP RIGHT CLAIMED WITH REFERENCE TO SUCCESSION LAW UNDER WHICH RIGHT EMERGES.

PROOF OF DEATH WOULD BE REQUIRED EVERY WHERE.
