Un registered contract deed

Sugar factory made an agreement with X to do certain work and paid Rs: 10 laks as an advanced sum. if dispute arises, Whether agreement is compulsorily registrable.

Author, Agreement which do not come under transfer of property, that deed comes under Optional registerable document. however what are the terms and conditions of the Agreement? as per query, the agreement is a BOT.

In my view, as per section 17 of the Indian Registration Act 1908 the agreement in the present can need not be registered.

The registration is optional however if there is a dispute in the court, when the opposite raises question about deficit stamp duty, then if the court passes an order to pay the stamp duty, the document after payment of stamp duty shall become a valid document legally.
