What emails should i submit as evidence

Guest (Querist) 17 October 2013 This query is : Resolved
Respected Adv,

My divorce case is running in family court and I need to submit evidences. Over the 3 years me and my husband exchanged emails. My emails were always cool , calm whereas his emails were full of false blames, abusive. Now he bring new story of desertion by me where contradiction is mentioned in his abusive emails.
My query is : I am submitting my emails. Sould I submit his abusive emails also just to prove his new allegatio of deserton ? or His abusive emails I shoud not submit as evidence?.
I have kid and want to save married life.
Please advice.

Who is the petitioner in case?

What is the ground of divorce?

What fact you want to prove?

Without looking into brief of a case it is
not advisable to express opinion if particular document should or should not be filed.

print out of e-mail is admissible piece of evidence.

it appears your husband wants divorce on grounds of desertion whereas you dont want a divorce . you have stated that you want to save your marriage for sake of your kid .

in order to disprove allegations of desertion rely upon emails exchanged with your husband .
please note that we have not gone through your divorce petition and opinion expressed herein is based on shorts facts stated by you .

It shall be better to show all e-mails to your lawyer and let him chose the relevant out of those.

Who has filed the divorce petition - you did not mention. That all depends upon who is the petitioner for divorce. Any way as Mr.Makkad saheb advised above, you can show the e-mails to your lawyer and find out if there is any use to defend your stand in the case.
