Workmen compensation act

At our project site one of our employee drowned in the river while working at site which is near river at Himachal Pradesh.

The dead body is not traceable. what is the waiting period to pay compensation the legal heirs of the drowned employee. what is the procedure

Legal heirs need not to wait, let them take FIR copy and file a case.
