False DV

My wife along with my 1.5 yrs daughter went to her maternal home on her own wish in nov'2015. In jan'2016 she sent a notice saying that me and my family member harass her and many such false allegations and asked for compendation. Yesterday we recieved a court notice that she has filed a false DV case against me and my family members. I wanted to the know the consequences and what measures we need to do to prove ourself innocent and to prove that she was the one who tortured my parents and me. Please help me

You must attend all the court hearings, read all her allegations carefully and gathered the proofs to prove your innocence,i suggest you amicably talk to your wife, convince her and bring her back to your home don't spoil your married life, there is nothing in litigations you will spoil many precious years of your life in court cases .

First of all, don't get panic and don't worry.

Whether she has filed a complaint at the police station or filed a DV case in the court?

Secondly, if she has filed a police complaint, then you might get a call from the police station for the enquiry or filing your statement. In such case keep the facts before the police in writing and mention all the details in your defence.

If she has filed DV case in the court, then keep your defence ready.

Dear Atul Where are you from? In DV or in any cases, do not go about proving your innocence. Sometimes proving innocence may lead to problems and may have a chance of boomrang. Instead go about proving other party is at fault and has filed the false case with a malafide intention. That is sufficient. The case will be dismissed accordingly. Do not open too many cards in the play of legal battle. Appropriate move and cards win the game. So is the legal battle. Take care. Have the names of your elders from the case in high court. That would be 6-8months. Till then stay on the proceedings on DV case. Till then keep quite after filing vakalath. Next file objections to her petition. Wait for order on IA1. If does not favour you, appeal. Wait for order on appeal. Next let her put evidence. Cross her. Next you put all your evidence which are passively defensive.
