 Subject: downgrading of the minimum qualification of Hindi
 Translator’s post in the PSU insurance co.
      The applicant recalls the GIC directions dated 13.02.1984* to all
 General Insurance PSU insurance companies in respect of relaxation of
 Minimum qualification from Govt of India  norms of Post Graduate to
 that of Graduate with second class on condition that the Board of
 Director’s ratify the relaxed norms.

 (a)     Copy of the Board of Director’s resolution in keeping with GIC
 directions 13.02.1984 for relaxed eligibility creiteria of Hindi
 Translator’s post in the OICL
 Appeal:The information sought from public sector PSU has been denied
 on behalf of a so called “department”.

 (b) Information of instructions,if any,from the Govt of India with
 effect from 1984 till the advertisement dated 31.10.2013 that the
 power of relaxation in qualification of Hindi Translator’s
 post,(admittedly,a statutory requirement...
 Appeal: The CPIO has replied of no information,he may once again check
 the record and ratify.

 (c) Information of the ground of deviation from the ealier norms.
 Appeal: The decision of public authority cannot be whimsical or
 capricious. Information need be disclosed.

 You are therefore requested to direct the CPIO to disclose the
 information without any further delay.

Information sought Para5:  (translated from Hindi) A PSU ought to avoid litigation with its employee(s) as per the recommendations contained in 126th report published by the Law Commission of India.

 

 

 

          In view of the above,the translators who are to be recruited on less 4 or 6 increments than that of existing translators (in the general insurance PSU company) are apprehended to resort to legal disputes on the basis of equal work equal pay.

 

 

 

THE APPLICANT BE INFORMED OF MEASURES INCLUDING PENDING/ CONTEMPLATED ONES TO PREVENT AVOIDABLE LITIGATION IN THE PSU INSURANCE COMPANIES.

 

 

 

Reply of CPIO: as per annexure (enclosed).

 

 

 

Appeal:                 The CPIO cannot stand up to shelter a whimsical or capricious act of an insurance company executive.

 

The reply of CPIO is not in keeping with the Book of Do’s and Don’ts applicable to each one of the decision makers of Public Sector (PSU) General Insurance Companies.

 

             The Book prescribes that a decision on behalf of a PSU general insurance company cannot be whimsical or capricious.

 

               The CPIO be directed to apply his mind carefully and thereafter disclose information reading carefully Para 1 to 5 keeping the  public interests of transparency and accountability in public life particularly when the information pertains to policy matter .
