How to stop the cell (Mobile tower) in residential area

Page no : 2

PALNITKAR V.V. (Lawyer)     25 February 2009

Learned friends have given very valuable information.

RAKHI BUDHIRAJA ADVOCATE (LAWYER AT BUDHIRAJA & ASSOCIATES SUPREME COURT OF INDIA)     05 March 2009

I do agree Mr. Ravidevraj.

Sudipa (Advocate)     21 August 2009

Hi

are u there

Rakesh Dubey (Executive Editor)     01 October 2009

Can anyone suggest how to find out judgement details from supremecourt.nic or similar sites. I would like to know if there is judiciary order banning installation of telecommunication towers either in Residential Building or in a Residential Area.

In fact, I am planning to allow a company to install such tower on my building, but the people in neighbouring area have requested me not to do so as according to them, such towers leads to health hazards.

Approach Human Rights Comission complaining your Greivance

Vikram (Advcoate)     26 May 2010

Dear Sunil,

Who has told you that mobile towers are a health hazard... we cannot avoid these towers unless we avoid our mobile phones,  because if as per your version the emissions from these towers are hazardous, then same emission is caused by your cell phone.... CLOSE TO YOUR HEART....

Lots many researches have been done in this field but none has proved anything...... In case you have some personal issues.. matter may be different..... But there is nothing like health hazard... Can you quote a single instance wherein you came across any death due to emisssion from towers...........???

If so please forwrad details to me as well... as I have done an extensive study in this regard.

Vikram (Advcoate)     26 May 2010

Said case, which you are referring to, has been dismissed for non-prosecution by the Supreme Court in January/Feb  2010 itself.

I am a newcomer in this forum. I wish to point out one crucial point to fight against roof top towers. The towers should have been designed  taking consideration of the existing buildings Load Bearing capacity along with the calculation of the tower. But I have seen 100's sites where one particular design and calculation, even sometimes based on Ground base same height Towers were used to construct ROOF TOP TOWERS one after another. The Design should be CASE to CASE Basis, not a general design, since the design and strength and particularly PRESENT CONDITION of any Two bldgs are DIFFERENT. It has to be.

Stress condition generated by a tower situated upon a MARKET bldg and on a two storied residential house are same but NOT THE CONDITION OF BOTH BLDG ARE SAME. Hence any company canot  rather should not consider a 15 Mtr Roof Top Tower design constructed upon a 4 storied Huge Market complex appropriate on a residential two storied bldg. BUT THE PREVAILING PRACTICE IS THE SAME. We should demand each ROOF TOP tower to be designed and constrcted based on EACH SEPARATE SITE DATA.

Govt should establish a highly efficient Technical committe to recheck the Design sheet WHO should sign and issue a SAFETY CERTIFICATE jiointly for the STABILITY of the tower.

Tapas das (self)     28 May 2010

If there is a valid doubt that a roof top tower might have been constructed without proper structural safety consideration what should be the procedure to stop it. The tower under construction adjacent to one of my relatives house is 15 mtr high and HUGE BEAMS were placed on the mumty room of a two storied small bldg after removing the plastic water tank from that place. The look is scary., almost like a 8yrs boy carrying 16 bricks on top his head like an adult majdur. WHAT SHOULD BE THE PROCEDURE TO STOP THIS.

I agree with Mr. Vikram. its only the hue and cry against the alleged harm due to radiation from cell towers. in that respect everything that the science brought for us is harm to us, like the CO from vehicles, air, water pollution and the radiation from other sources. the people who speak and worry about the tower radiations should first remove the cell phones from their  and their family members lives then go for a protest against the towers. this cry is like a protest against the fire and fume from the cooking source which you dont want abut still want the delicious food cooked on the source.

nextly, as Mr tapas das has stated his observation about the stability and design of the towers, he has not thourougly gone through point. the towers those are built over the land are absolutely not the same which are built over roof tops. the height of each tower is fixed basing on the requirement of coverage in the locality. moreover the towers are designed so as to withstand the wind speed in the  locality. these towers are never placed on a load baring walls of any building. a NDTA test is carried out for the building before a foundation design is made. the foundation of the tower is so designed that the complete load of tower is transferred to the  columns of the building. even ther is a minimum criteria for the steel of the columns. the companies do not blindly built any tower of any height over any building as they come accross.

further there are least of least incidents where a standing tower fell or a building collapsed due to the weight of tower over it ( through out india including the costal areas).

i hope this very brief information is helpful, if not, iam ready for any debate over the topic. available on my personal id too ::::: jilan_sm@yahoo.com

I just cannot believe that people are actually still debating on whether these towers are actually harmful or not.... HIGH levels of radiation are harmful in the long run and THATS the contention.. the radiation from cell phone towers in Mumbai are ridiculously higher than any of the norms prescribed across the world.... to blame science for everything evil is just naive...science gave us the means.. now its our fault that we cannot use it the way it should be. instead of investing in technology where we can have better signal and less radiation, cell phone companies are actually fighting to keep the ones intact just because new towers would mean newer investment in infrastructure....

to say that just because no one has died from emissions is also a weak argument. Also, debating the sanctity of reports is always the first defense of cell phone companies...

lets not talk like lay men. lets come up with substantial evidence for eithor side. be it the hazards of radiation or no such harms. public is filing PILs against such alleged radiations, but the courts are dismissing them after thorough enquiries.

to be more specific, a new technology has always been put to debate in history so is the telecom now. we are very slow in accepting the change in technology. just imagine how the life would be without the cell phones today.

comeup with proofs not mere allegations
