There is a judgment of justics J R Midha that during the case procedding, If any application filed u/s 340. Then courrt will decide 340 application first and then main case procedding will resume.
Also.. in case of sanjeev kumar mittal VS state(test case 19/2004) J R Midha taken very strong view on 340 and filing of forged documents in court in its 65 pages jurgment.
i my case wife filed false affidavit of income and asset, so,, if i file 340, then court will decide 340 first, then proceed further with the main appeal file my wife in maintenecne appeal in sec 24 of HMA .?
