Property dispute

I own a land, for which i hav all the original documents. The fencing was not done for the land and it was vaccant for long years. The road wasnlaid over my land. Later when i was about to build fencing. The public raising objection that is an encroachment. Whats my right over the prooerty now. As perbthe documents the land on which road is laid belongs to me. Please reply as sson as possible.

Did you get any notice for the authorities of municipal corp. for the acquisition of your land for the purpose of road? If your property comes under the Municipal corporation limit.. then contact the concern authority. You can also use the same area FSI to some other place or convert it into TDR.

There is no acquisition here. we didnt have fence for long years. so the authorities laid road and part of it passes through our property.now can we built fence over this road

Sir,   it is found that the the party pposite to our land has encroached the road..which lead to the deviation of road to our plot. Now objections are raised by the party opposite to our land not to build fence raising that we have encroached the road. What is the state of the property on which road is laid and what action to be taken here and how to proceed to retreive our land. Thank you .

You may consult an able counsel specialzing in such/property/revenue/civil matters and after all proeprty documents (chain of title) is examined by your counsel you may approach the authorities that have laid the road and register your objections.

 

Such authorities do have thier internal officials  that have to examine the land related documents e.g. Naib Tehsildar.

If the authorities do not act you may approach court, under expert guidance of your counsel.
