Threaten by employer

ON 11TH OF NOV OUR GM HAS COME TO OFFICE AND TOLD US THAT EVERY 1 HAD A TIME OF 31ST DEC AND GO AND SEARCH YOUR JOB, IF ANY 1 WANT TO GO SEND ME 1 DAYS NOTICE AND LEAVE, THAT IS WHAT I DO AND LEFT THE JOB, BUT NOW HE THREATEN ME TO DO THE FIR, I ALLREADY TOLD THEM I WILL COME ON SUNDAY AND MATCH THE RECORDS, BUT HE IS NOT LISTNING AND THREATEN ME WITH DIRE CONSICENCE

FIR? for what reason? and on what grounds?

I don't think he shall be able to do that. Rather you can take a legal action against him in this situation.

A First Information Report is a written document prepared by police organizations in Bangladesh, India, and Pakistan when they receive information about the commission of a cognizable offence. So your offence is not cognizable

GM cannot act as per his wish and fancies. He is bound to obey the terms and conditions of your employment as well as Labour Laws. You can always approach Labour Authorities(provided you come under the definition of workman) to protect your rights. If u dont come under workmen then you can seek remedy by way of declaratory suit.

you were working in which capacity?

were you dealing with any records/accounts?

where records are not compiled?

FIR is being proposed on what allegation?

You have obliged him with your resignation on platter with 1day notice.

The establsihment may adjust notice pay in FnF statement/settlement.

You could have tendered notice of resignation with full notice period descrining that on dated.........................Mr/Ms...........designation ................at address.........................asked to resign................and then asked him to accept it with immediate effect and provide you an acknowledgment of notice and acceptance of resigantion.

 

You could have recorded the demand of resignation (audio/visual/witnessed/minuted).

 

You are probbaly asked to handover the charge/assets, NOC/NDC etc

Isn't it?

 

This can be done by mutual understanding.

 

Record the threats.

 

Why the GM has asked everyone to resign?

Is the establishment closing down; office/establishment?
