Urgent assistance required on dv, 498 & 125 case

Hello All,

 

I have got lot of information from you people. Me and my family are out on AB i am really thankful to you people. Specially Mr. Shonee Kapoor who assisted me whenever needed. coming to the point directly. I already have Maintance case 125 in court still on hearing no decision has came out yet. first hearing was in september 2012 and last i had was on January 16th 2013 nd coming up on February 13th 2013. second case i have that is of 498 on which me and my parents are out on AB. Now suddenly 4 days back i got summons from court for me and my parents that they have filed Domestic Violence case. Its under mine my father's name and my mother's name.

I did read somewhere on www.498.org that Domestic Violence can be file only against Male members of family but the summons which we got we have my mother's name as well. Is that right? if its right we have to go to court. If its wrong than what steps shall we take? and what should i do further about all of these cases. I would not go for RCR because whatever cases we have on our name all are false and fake so i dont want this kind of girl back in our family so i wont choose RCR. Can i go with RTI ? will that help me somewhere? Shall I go for Divorce Case?

 

I am Totally Confused.

 

Please Help Me.

Dont worry for DV case, if you read summons it would be clearly written there that either you or your lawyer should be present there.

 

It can be filed against female members also.

 

Its just pressure tactics to file more and more cases. Try to explore options where only your lawyer goes and takes next date. Frusterate other party by not showing up unless otherwise asked by judge.

and yes, 

you must file for divorce now - unless u file it, u wont get it

hello,

DV case can be filed against persons who was in domestic relation with victim.

first concentrate on your defense.

counter cases can be done later on.

why u want to file RTI ?
