Appeal counter staement

(Querist) 22 March 2014 This query is : Resolved 
I am the respondent in a civil suit pending appeal in MADRAS HIGH COURT. It has been almost 8 months since I received the appeal notice. I just realized that I have not filed a reply statement yet, I always had the reply ready. My question is
1) Is it necessary to file reply statement?
2) If YES then is there a time limit?

It is not mandatory to file written objections to appeal unless you have any objection to the decree or point decided by lower court. There is no provision to file cross objection unless you are objecting to the decree. So the appeal will be heard finally in presence of both the parties and you have to only argue the matter and appellant has to first prove that lower court has committed error in passing decree and then you have to argue on how the lower courts findings are correct
