An organization offering loan has claimed to be a company in its website and also in the e-mail addressed to the loan applicant. The letter further states that they are NBFC which is false. Can they be fined under Company Law?
They have also insisted that witnesses to a document has to sign on revenue stamp?Is it a valid in law as witnesses do not discharge any monetary obligation? Can they insist on such onerous clause?
Can on organisation give loan without a license under moneylender's act?

Respected Seniors, I was working with company located at New Delhi joined in April 2016. When I joined they asked me to stay at Delhi for 1 month it my own cost. (I am based at Mumbai) Since I was in need of job I accept their terms. At the time of joining they gave me offer letter without mentioning the salary in it, they said you will get it once reach Mumbai.
Till November 2016 I use to get my salary in my salary Account in HDFC bank by 20-22 of next month. Since I got some issues I requested them to pay my salary by cheque instead of crediting in my salary Account.
In the month of December and January 2017 I got my salary almost one month late. So I had hot argument with HR. In the month of March my visiting cards got over so I have asked my HR for visiting cards but they said since my performance is not up to the mark company don't wish to continue my services!!!! Then I spoke to my CEO and surprisingly he said I am giving one month you get the business of 50 Lacs!!!! Which was next to impossible.
Now till date, I have not received...

Please advise, what kind of mail I should send??

My Flat had been under mortgage with a Bank as third party security towards credit facility availed by a pvt ltd company belongign to my close relative..The Company have defaulted in Payment, the account is now NPA. The Bank has issued Notices to me and have taken symbolic possession of my flat 10 days ago, and have published a notice to this effect in newspaper today.I am told that the Bank now shall take permission from DM for forcefull phyisical possession and its sale.Also I can file some kind of petition at DRT Court.I will do what I can do to save my flat. My relative also do not have bad intention and assure of all steps to save my flat.But I see on daily basis E-Auction Notice by Banks even without taking Physical Possession on As Is Where Is Basis. This can also happen to me .
Any remedy/advice in such circumstances ?

My wife wants to start an online education business. The courses will be like-
financial planning,Investment management etc.
We don't know the legal process before launching the online business.
Please provide advice regarding the following-
1. Can she start her business from her parents' home address in West Bengal? Is NOC from parents or commercial power connection or any other documents required then?
2. She wants easy to manage paperwork for her business. Which type of business structure should she form- partnership/LLP/PVT LTD?
3. What licenses should she get - Municipal Trade license,VAT,CST, GST?

The Company, in which I am working as a Senior Accounts Manager, is an Unlisted Public Company. The Company had taken Unsecured Loans from the Directors of the Company to the tune of Rs.3 Crores. The Directors now wish to convert their loans into shares of the Company.
What is the procedure for converting loans into shares?
Are there any case laws for the same (in case if there is any Income Tax problem)
Please provide the necessary details at the earliest.

Cheque bouncing-company in nclt
Dear Sir,
My query is whether any provision in NCLT law is there to protect company against cheque bouncing case .
I was issued cheque against my full & final settlement, these cheques are getting bounced now, The account from which company had issued cheques, has been stopped by the IP and they have been instructed to use the CC account. When I approached the CEO/Directors of the company regarding this issue, they said as per the NCLT law, we are not responsible for cheque bouncing as they have not stopped operating that bank account but IP did it, also that NCLT gives shelter against cheque bouncing case.
Kindly suggest how can I fight for my legitimate dues.
