Divorce

Sir,

I want to know if decree is given immediately after the completion of six months mandatory separation period or can divorce be given before completion of statutory 6 months period as i am in my 4 th month of statutory period

In lower court, the documentary evidences against the respondent gets proved to be true but the petitioner fails in the cross examination to prove the main fact so the order given ex parte does not get set aside by lower court. Now can the petitioner still go to upper court on the basis of the documentary evidences which are already proved to be true ?
For ex. Petioner proves one false statement of the respondent by some documents but petioner in cross examination fails to prove another statement based on which the appeal has to be heard and decided. So the merits are partial from both the parties that means both petioner and respondent seem to be false at some points. So how the court will take decision?

CrPC 125

Sir,
i am a house wife and my husband filed a divorce court. My lawyer is saying currently for maintenance only CrPC 125 is best suited for me considering my present situation so we filed the separate case but my husband is not collecting the notice at both his home and company addresses. What will happen if he does not claim the notice at all the time?

Dear experts,

I would like to know if husband gets ex parte divorce, wife challenges the order stating some false reason and if the husband proves that the reason mentioned in her appeal is false, will the court set aside the decree? If not, can she have chances of getting it set aside from upper court?

Internal Story - judge's decision

Hello Respected Experts,

This is very general question but having the truthness behind the story.

I have heard that some of judges in civil cases are directly accessed and also given the fixed amount, the judgements of these judges can be changed accordingly.

Defintely each field can have some sort of corruption involved but I wondered where the cases are justified on the merits, how the judgements can be changed with power of money? if someone comes to know that the judgement he got is not justified then what that poor fellow should do in order to get the justice in such a situation?

Pls suggest as your inputs can save many people if there is any solution. What one could do if it happens in matrimonial cases like divorce?

Hi i was in love for 10 yrs and got married to same girl lived for 3 yrs and suddenly she left me one day saying i drink i lie i go around with girls etc.etc but whereas the only truth was i used to drink but within limit and she used accompanny me before and after marriage now its in the court and she has agreed to pay me 1 lakh for mutual consent.its almost 3yrs now since we have seperated and i live alone in a pg b'cos i had a site which i sold for our marriage. and i hvent taken a single paise from my inlaws.she works for a bpo and earns a good salary of 40 k per month .within these 3yrs i lost everything i had just b'cos of depression where as my wife is staying with a guy seperately whereas her parents stay here itself and in the court i could not prove anything as they were not listening to me but at counselling when i was adamant of getting her back not a divorce she offered me 1 lakh where as now i think thats too less where i have spent nearly 6 to 7 lakhs for just the wedding what should i do to retain her or how can i demand more as i too have life and too need money to lead the same please help me as the court date is on jan 12 2010.thanks

nullification

i married on march 10th 2008 due to premarital pregnancy by somebody other than me she did not accept to sexual intercourse then finaly she accept her pregnancy,then she threaten me if you told to my home i will commit succide it will hamper as your a government servant.because thier family member think government servant should have to pay money after separation.i am living 2000 km far away my hometown .after 3 month i visited my hometown then she ran away with his boyfriend. she aborted her foetus there . i filed suit against her for nulification ofb marriage after 6 month of my marriage. she never appear before the court about 1 year.inmeanwhile she send lot of complaint personally to my official she creat scene 3 lakh demand of money by my mother so she separated forcefully . she requested by complaint to deposit my money in her account no particular given.she hide the filed suit against her complaint as well as pettion for maitenance in court. after several attempt she negotiate for money from my advocate side. but i refused then she came to my home with goondas & try to attack my family member. then my family member call police then the came & enquire that girl she told to police my mother for 3 lakh demand & she falsely allegated my brother try to rape her & no one family member not allow to leave with her.at the time i am working in outstatioon so i unable to came before police my brother shown him pending case to him . but inspector call me for enquiry i already spent lot leave for my both prooceding in court .so she didnot give negative complaint againt me. police try to counsel both but i dont like what i have to do pls advice me.police station order me to attend the enquiry. already my family member submitted pending report and her complaint letter for to deposit 10000 rs for her account number.in that letter she told due to journey the child get aborted. but now in police enquiry she told due to my family member compulsion she aborted the child. can i get her falsely written complaint of her from police station.is it compulsion i have to attend the enquiry. in police station she told about me he met in person he will join with me. but i forget to told this thing after my marriage one in my outstation she try to strangle my throat fortunately i thrown away her.it is complicated if i go to home she may arrange some trap for me pls advice.
