Adoption query

A number of children have become orphans in Wayanad where the natural disaster took place. A couple of my friends don't have children. Can they adopt a child? Among them, the husband is 62 years and the wife is 52 years, so will there be any age bar for adoption

Married sister influenced and turned father against us

I lost my mother 5 years ago and shifted my father from home town to my rented house, sold home town house and myself and my younger brother invested whatever savings we had to buy new house in Ghaziabad, took personal loan for furnishing work however the house is registered at father’s name.
Since then, there was too much interference by my married sister in my family matters and she talks to my father on calls for hours about everything happening in my house. I didn’t mind initially as I thought she is giving mental support to retired lonely person.
As living in joint family there always be small things happening between family members which is further reported to my sister by my father, she started provoking him to turn against us. My father started shouting and making scenes of small things.
But now, water is passing over head. Since this property value is increased and I guess my sister has her eye on this property she influenced my father to ask us (My immediate family + My brother’s immediate family) to vacate this house.
Now my father off course influenced and guided my sister has asked us to make a rent agreement and start paying him rent as we live there, I eventually agreed and thought this atleast will give us some peace of mind. I agreed to pay 5000/- every month over all other expenses (his wifi, medicines, grocery). Now he is demanding 15000/- plus expenses. The purpose is to kick us out from the house.
Which obviously we refused as I know that later when my father’s health will deteriorate there will be no one to take care, also we do not have any place to go and neither I am financially strong and invested in this house whatever we had.
Now I want my sister stops influencing my father and stop turning him against us. Seeking help that legally what options do we have?

Bns 379 by husband against 498a case by wife

Me as a wife, filed 498a, Dv & 125 cases on husband. He nd his family are serial fraudsters, they hide their real identity and dupe innocent families for money.

After 1.5 years of marriage, I came to know that my husband was already married as I saw his first marriage affidavit (we have evidence) in his suitcase. He never took care of me, abused my parents, and kept affairs with multiple girls. His mother snatched by jwellery and locked house when I tried to leave. His father abused my dad and said that you should cut your daughter in pieces, she is mad (we have recording).
My husband never took his responsibility nd neglected me during typhoid. He kept abusing my mother to provoke me and then record my actions. I have suffered a lot.

After one year of filing cases, my husband again misguided us in mediation, he kept saying that he wants to take me home on rent, and took atleast 7 dates for mediation.

He did that to get interim bail on the name of mediation and keep extending the trials. In the end, we asked mediator to send final report as failed. Now husband has filed BNS 379 case on me, because we have submitted wrong info in income affidavit in maintenance (lawyer insisted us to do that).

Today, I am not working but my husband is asking for inquiry and putting same allegations everywhere while we have good evidences of his abuses, first marriage, and harrasment he did to me. How can I counter him further? Trial will start next and husband is trying on scare us with such counter cases.

Unmarried couple staying in flat from last 5 months..

What is the law in India regarding an unmarried couple staying together with their own consent in one flat from last five months?

My age is sixty years and her age is fifty years..

Is there any case against me (male partner), as female partner is no good to be as housewife in anyway/her habits are like women's of dating/sex chat online..

She still has many male persons in her contact and still she carry on her online dating/sex chats from my ownership flat..

I am retired person and bring her to my life considering that I will have peaceful life staying together as happy couple ..

I told her many times that I take you back to your parent house in Siliguri, West Bengal, but don't want to leave from my ownership flat.

I get in contact with her from jeevan saathi matrimonial website, six months ago..

Parents/Family of female partner forcing me to keep her from last five months that you (male partner) has to keep her for the remaining life or I have to face the police case / legal case against me (male partner).

I am in Vadodara and she is from Siliguri, West Bengal, India.

Marriage with muslim man with khulla

Hi, I'm a Hindu woman and my fiance is a Muslim man who has got khulla from his ex wife. The khula nama is issued by qazi.
Now we want to apply for special marriage act. Is this khula nama valid or will he need to apply for divorce decree?

Please do help understand what are the possible ways without having the need to contact his ex wife.

Change prayer in petition under the same section

Hello sir/madam,

I have filed a petition in sub-court under section 12 and 13(1) of Hindu Marriage Act because of the non-consummation and cruelty caused by my wife. But in prayer, it is mentioned as "decree of divorce due to non-consummation and cruelty". I wasn't aware that it should be "decree of nullity" u/s 12 of HMA. Right now, they set exparte.

Now my question is,
- Will they give judgment for nullity of marriage as the section mentioned in the petition covers both nullity and divorce? If the marriage is nullified there is no concept of divorce because marriage itself doesn't exist in the first place.
- It is right now in the Exparte Evidence stage, if we submit amendment petition to change the prayer, Will they again send notice to my wife? Or as the main case is set exparte, they will just allow it?

Hello,

I am a working professional having around 10 years of work experience. I earn around 2.06 lakh rupees per month. I am a Post Graduate. I got married in 2019 November. Before marriage my wife & I decided that since I was working in Mumbai, I would be settling in Mumbai. My parents used to Live in Aurangabad (MH). My mother before my marriage was a Cancer Patient (SInce June 2017) and my Father was a COngestive Heart Failure Patient (since March 2018). My wife is a Chartered Accountant. Before marriage she was a working as a partner in a CA firm in a Tier 2 City in Gujrat and earning around 45000 rupees. Currently we are separated and I am taking Care of my Father. My mother and her mother have expired. If I earn as I mentioned above and she earns 80K per month and she is willingly living in Mumbai even after my strong opposition to that movement by her own. She is asking for maintenance. If she approaches court (she has already given me a lawyer notice and asked for 1 crore rupees mental harassment compensation), how much will the maintenance be in this case? We don't have kids. I support my father with 27000 INR per month. I pay my maid around 5000 per month. All household expense are around 15000 and Savings are around 30000 per month. I have a car loan of 44000 per month as well. I am not aware of the breakdown of her expenses. I only know that she is earning around 80K per month.

Undivided immovable property


There is a unregistered (christian)family settlement pertaining to immovable undivided property where in agreed by all share holders that the property is to be equally divided.
Query is when one of the share holders dies.. Who is the rightful owner of his share? Is the share be divided among the remaining living share holders or the wife/siblings of the deceased share holder..
