I applied to my ex employer for getting my gratuity after almost 11 years of continious service vide Form I and Form N on 07/12/2016 and 29/06/2017 respectively. My last date of service was 06/11/2016. The Controlling Authority here in Kolkata, West Bengal notified me and my ex employer to appear Vide Form "O". The OP was failed to appear and submit their AIC for 03 consequtive dates, hence my EIC was recorded on 07/06/2018 as per instruction from the Deputy Labour Commissioner.There after OP had started cross examine me which lasted for 03 days starting from 16/07/2018 and concluded my cross examine on 18/01/2019. They also didn't appear quite a few time during this period. Since then OP has only submitted their AIC but failed to appear before the controlling authority for OPW. They have escaped 10 months since my cross examination was concluded on 18/01/2019 by giving this or that execuses or may be asking for adjounment for the day.They didn't appear consecutive second day on last 11/11/2019 and once again controlling authority fixed up a date on 20/12/2019.
I tried to put up the scenario to the learned experts how the OP is trying to delay and dragging the process. I would like to know from the experts a) can OP delay the process as they have been doing, b) Is there any provision in the law to restrain such activity, c) Doesn't have the Controlling Authority any power to stop thiese practise and speed up the procedure.d) Is there any other authority where I can plea for a faster proceeding.
I look forward to your valuable suggestions \ advice and I welcome any suggestion from anybody which might be helpful for me.

My spouse worked in Central PSU and terminated from service. We preferred case on the department against termination. Till date CPF amount has not been settled by the department (both employee & employer contribution). Our advocate told if we claim CPF amount, department will pay only employee contribution and it will have impact on proceeding our case against the department. If we claimed now, we will not get back wages benefit if we won the case. Pl advise.
Respected Learned Experts, I am a Central Government staff and made retired Compulsorily after a departmental inquiry. I have filed an OP before the CAT Bench, Chennai for payment of provisional pension which is due from 2017 onward as judicial proceedings is going on. The CAT Bench has passed an order directing the department to pass appropriate order on my claim of provisional pension along with interest within a period of two months. Even after the lapse of stipulated time which has been completed on 27/10/2019, my department has neither paid the pension nor sent any intimation in this regard. I had quoted 3 officials (designation wise) in my OA as Respondents. Whether I can file Contempt Petition against only one official who is the Competent Authority to sanction the pension. Further, Whether I have to file Civil or Criminal Contempt Petition before the CAT Bench. Thanks to all Experts in anticipation.

If one works for 4 years 10months and 10 days of continuous service in a company, Then will he be eligible for gratuity? If eligible, please provide court judgement in support of this.
In the year 2014 I started my MA(Regular) and just after the completion of 1st year (2 semesters), I got selected in LIC as a Development Officer in 2015. After that while working in LIC, I also completed my remaining 2 semesters (till 2016). For that I asked the permission from my BM in written application and he granted the permission at both the time of my 3rd and 4th semester . But I didn't take any copy of the application at that time. Then I resigned form LIC in 2017 March.
Now, this year (2019), I got selected in Public Sector Bank in a post on the basis of that MA degree. Now the question is that, will this create any kind of problem in the future as I completed my MA while I was in job?
As somewhere I heard that we cannot do any regular course along with any job..Please help me .. I m really worried about this... because at present I don't have any proof that I was allowed to appear in the examination from LIC...
(From College side everything is clear. I have got my all Mark Sheets and Degree mentioning that I was a regular student of the college....and my college was in my home town and my workplace was 250 km away from my hometown)
