my grandmother had written a will in the name of my grand father with rights to property. Now my grand father had written a will in favour of my uncle with rights to property leaving 8 others of his children. Both of them passed away.
My question is, is my grand father's will legally valid as he got the property from Grand Mother and not earned by him.

issue is not divorce, but the grounds stated. In other words ok with divorce but would want to contest the baseless allegations.

In this case, wife never attended procedings of RCR inspite of having knowledge and hence the judge decreed exparte.a year ago, looks like there is a fake DV case that the husband might need to fight, will the exparte RCR help the husband? if yes how effective could that be?

I would like to know if DV can be filed against mother and sister of husband who are not living in the same household?
DV was filed in 2010 in the police station but not pursued in the court of law, but none of us were informed of that and in fact we only came to know about it this week when I have sent an RTI application for information regarding a fake arrest
What should we do now?

This is a case of fake 498A and DV.
In Nov 2010 Police had made a fake arrest ( Arrest never Shown) . Was detained in the PS for 3 days under a fake 498A Case where in no case is booked and not even an FIR. Entries were made in the local police station with respect to the arrest of the accused before taking him to the PS in which the so called complaint was registered. Entries made in the local police station with respect to the arrest have been manipulated and changed to as “police personnel from the PS in which complaint had been registered had travelled to the concerned PS to conduct an enquiry about the accused in CR NO ..... of 2010 u/s 498A”. The accused later on had obtained a copy of the above General Diary entry. He had also asked the police personnel of the PS in which the compliant was booked for details pertaining to the arrest. Police have not responded and when the matter was submitted to the information commission, the police had sent a reply stating that there is no 498A and it was a DV case so there is no information that can be supplied and hence the claim of arrest is far from truth. Now there are different entries made in different police stations with respect to the same matter.
So my question is how to prove that the Police have given false information and how to take the matter further with respect to the fake arrest?

Can a DV case be filed at the home town of the complainant when the husband and wife are not living together? ( Parties concerned are living separately for the past 2 months )

Can the police conduct an inquiry directly based on the complaint?

I have tried enough to get a highcourt lawyer who can help me file a writ petition on the merits of the case. Either they are too busy that they give their opinion even with out listening to me completely or look at the technical aspects of the case and leave the merits. In fact I have wasted a lot of money because of a lawyer who took me to the technicalities of the case and not the merits.

I was given a case number as CR65 of 2010 u/s 498(A) IPC during my arrest
One Inspector of the police said that it is not a crime number.
My lawyer says that it is the crime number. Hence I would like to know what is the exact format for an FIR Number and a Crime Number

My grandfather died in 2006. He left a Will in favor of my uncle and his daughter. The property in question was inherited by my grandfather through a Will from his wife back in 1995. Unfortunately, we were not aware of all of this until about August 2012. My father and his other siblings did not bother to ask for a division of property due to a court case pending against one of our prime properties. Now, after coming to know about the Will, we have had several discussions with my uncle, and all our relatives tried to persuade him that it is unethical of my grandfather to write such a Will and that the property needs to be shared equally amongst his siblings. In spite of the best efforts made by all of us, my uncle is bent on not sharing the property with us.
My father, mean while started searching for some documents to contest the will if required, and came across some documents which prove that my Grandmother’s will is a forged one. We have got certified copies of 2 documents which were signed by my grandmother in the presence of a magistrate and the signatures of the 2 documents do not match to the slightest extent possible with that on the Will.
Also, in a civil case on a rental dispute, during the course of argument, my grandmother pleaded with the judge that she had nine children and an insane husband and that she wants to give her property to her children etc. All of this was recorded by the Judge.
The person who signed as a witness to my grandmother’s Will was surprised with all of this as he was not aware of the fact that it was a Will of my grandmother and told us that he signed the Will presuming it to be the will written my grandfather. He is willing to help us in the court of law as he feels that my grandfather betrayed his trust.
Can we use the above evidences to contest the Will of my grandmother and my grandfather and get our rightful share of property?
Some lawyers did suggest that we contest the will as we have sufficient evidence against the forged Will of my grandmother and the insane attitude of my grandfather.
However, I would request the legal opinion of the experts in these forums so that we can make a sound decision to contest the Will.
