Declaration suit

person A purchased the field property from B in 21/03/1988 by way of registered sale deed and B died in 1989. But the Talathi (Revenue Officer) Mutate the name of all legal heirs of B in 7/12 extract of the said field property along with the name of A.

A approached to the Tahsiladar for deletion of name of legal heirs of B from revenue record but the Tahsildar passed an order in 2008 and mentioned that till the declaration by the Civil Court regarding the correctness of Sale deed the name of all the legal heirs will be on record?

(Note :- Since 1988 the field property is in possession of A)
I am for A


My questions are

Which suit I have to file? (Declaration and for Permanent Injunction)

What is the limitation for filing declaration suit ?

Partition

That the widow claiming the share of her husband to the daughter-in-law of her husbands brother in the ancestral property, but did not make all the legal heirs as party in that suit

Whether the suit is tenable ?
Whether all legal heirs are necessary parties ?

Power of Attorney for purchase of flat in company's name

Hello,

My director wants to purchase a residential flat in the name of the company. Can a power of attorney be executed in favour of an outsider to purchase the flat & complete all the formalities including registration.

The person is niether director nor an employee & is not assciated with the company in any manner?
Can this be done?
If yes, then what value of stamp paper to be used for executing the POA?

Our lowering professional standard

Dear Friends,
Good to be back after a month.
From the querries asked by our learned brothers it seems that they find it difficult to even expalin in english.
Is our professional standard decreasing?
Its of sure they need to try hard to over come we can even help them by submitting files for developing english.

Roznama

Sir/Madam,

Recently I procurred a copy of the Roznama to check and bring to the notice of the court that the complainant and his Advocate were being regularly absent for proceedings to my surprise the complainant has been marked as present on the last hearing while actually he was absent and the complainant advocate has filed an application for adjournment on this ground as the complainant was absent.

Further on the previous hearing to the above the complainant and the complainant Advocate both were absent and the application for adjournment was delivered to court by their office boy and for this act the complainant was penalised Rs.1000/- but the Roznama states as Advocate present.

What should I do?

Dear friends,

Is it legally possible to recover court attachment from the monthly pension payable to a pensioner under central civil service (Pension) Rules, 1972? when there is no source of other income for the pensioner.

If yes, how much maximum could be detected from the pension monthly?
