Mother's ancesterol property

(Querist) 07 July 2012 This query is : Resolved
HI
My mother got some share from her ancesterol property.....but now she is no more......
We are the two childrens (brother and sister). Now my question is that the property will be divided equally to both of us or father will also have some share in it ..there is no will for property distribution from my mother's side.

what basis you say property is ancestral . merely because your mother got some share from her parents does not make it ancestral .

since your mother died without leaving a will your father and the children have equal share in the property .

why dont you want your father to get a share?

Dear Sir
Its not the matter of father's share sir but somebody told me that only kids have the right in mother's property.....
Its ancesterol because this property was earned by her grand parents not by her parents...

Any property coming in hands of a female Hindu becomes her absolute property under section 14 of Hindu Succession Act which in absence of any will by her shall be succeeded
by her heirs who are her children and husband
under section 15(a)of the said Act.

Hence in your case along with you all your father is also the heir.
