Noc for change of use given by promotor

Dear sir,

I own a flat in residential housing society in Pune.Our society registered in Sep2011.But before that our promotor gave NOC for change of use to 3 no.of flats owned by original landlord.No written permission was taken by promotor of any of the flat owners.(as society was not formed at that time).Is it legal?if not what society can take action on these flat owners & promotor.
