Lic policy

I have taken LIC Market Plus Plicy in the year 2006 and invested Rs.1L. It was matured after 5 years and I have forgotten to surrender and claim the same. Even my Agent also did not inform me. after 6 months when I realised and enquired for the same I am told that the total maturity amount is Rs.1.25 L only. It was shocking to me, if I invest even in fixed deposit I would have get much more. Above to this shock I am told that the policy is converted into pension scheme where I cannot take back my money. but early I will be paid Rs.8000 only. Being a small employee and my earnings are very meagre wish to invest some benefit schemes but it turned to loss invest scheme. the said amount can be released only in case I fell sick and bed ridden. in such case also 25% will be deduct and balance can be paid to me.

Is not just cheating by govt organisation. How any govt organisation can focefully convert and put nasty conditions to take my money back.

Can you suggest any way out please to withdraw my money.

Hike of u/c flat after registration

Dear Sirs
I have booked a Flat under construction from a reputed promoters from Navi Mumbai in the year 2010. After 20% advance (2 Lakh) payment, the flat under construction was registered on my name and I have applied for Bank loan for 8 Lakh which was granted and the bank is paying to the Promoter on phase wise development. In the said town ship there are about 5 to 6 towers each tower contains some flats. The tower where my flat is to be constructed was in trouble for long time due to dispute with the promoters contractor. Rest of towers are completed expect our tower. Now after a gap of almost 2 years, the promoter is completing through some other contractor. So far my payment is Rs. 6.5 lakh (mine 2 lakhs Bank 4.5lakh) but to my shocking a notice was shooted to me for payment of almost 7.5 lakh which is 4 to 5 lakh excess than the amount agreed in the registered document.

Can you advise the remedy please.

Servicce tax and vat

"A" is the 2nd purchaser of a Flat in a multistoried Apartment where society is not formed. If "A" want to sell his Flat to an another individual, Can the Promotor demand for Service Tax and Vat from the 3rd Purchaser of the Flat.

Registration & stamp duty on car parking area.

The Apex Court and High Courts alos made a rule that Builders not to sale the Carparking space and they are bound to provide. In such case, There is no sale of Car Parking Space and no consideration payable to it.

Some Builders are demarking the parking areas to avoid confusing and quarrel between the Car owners on parking space.

On the other hand, in Maharashtra if we go for Flat registration, if the document specifies specification of the Parking slot, the SRO charging Stamp Duty and Registration charges calculationg separately for the parking area. If Car Parking space is not salable as per Rule how SRO can charge for it.

Stamp duty on nda.

Please clarify, what stamp duty is to be paid on NDA ( Non Discloure Agreement) between two companies. If attracts under which provision. Preparation of the document SAFE SIDE on some NJS is on different aspect.

Tax on commission.

A relegious Trust is paying some amount to an individual towards commission for helping them to get some donations to the trust. What Tax implications will have to face by the individual. He is not a commission agent or broker. the said commission may be one time but huge. He is ready to complay all statutory rquirements.

Kindly give your valluabel opinios / suggestions.

Validity of registered docuemnt??

As per Registration Act every immoveble property is to be registered for the purpose of :
1. For having good Title over the property and
2. Peaceful occupation and enjoyment of the same.

The said two are the basic reasons for a purchaser purchasing of any property from any person and to get it registration done. It is also clear that un-registered document is not having any evidentiary value. So as per law, only payment by way of stamp duty and registration charges gives evidentiary value to the document? In such case all registered documents on payment of proper stamp duty, there is no doubt that, the document is a valid one.

My question is, if the govt authority impose charges by way of Stamp duty and Registration charges, it is govt’s moral responsibility to protect the right of the purchaser also Simply Govt cannot wash their hand by saying that my duty is only to receive revenue and I cannot ensure the right on the property. Then what is the meaning of registration and evidentiary value to it.

I come across several incidents where builders / agents etc., selling one property to several people and all such docs are registered by paying all legal charges to get the validity of the document. But finally no one can have clear title over the property. How can govt can escape by saying that buyer has to check before purchasing. I differ here, if the govt records are foolproof and crystal clear, then such incidents will not occur.

Now a days technology improved, like bank transactions within seconds you get the transaction details of your account. How come our govt is not implementing proper system to protect the genuine purchasers interest. Surely I can say only genuine buyers will fall in the trap of cheaters those colluded with govt officials. All such purchasers are from middle or lower middle class. Their hard earned money is spending to purchase a house or flat but because of insecured govt system they loose money and no where there is a protection for their money.

The income after payment of Income Tax is legal money in the hands of the citizen of India. It will be the Govt duty to protect the interest of the citizen. Otherwise, for what purpose, govt collect various taxes from the citizens. How can the Govt escape from their responsibilities. Why courts also support govt., always in revenue matters.

Pl explain if there is no such protection to the tax payer, for what purpose Govt can collect taxes. Will it not be against law. If the same law is applied by a citizen it is called illegal and if the Govt follows, it is legal. It is our great Indian Legal System.

Dear Members,

I would like to know from you experts that what will be the prescribed stamp duty to be paid on letter of subrogtion issued by the insured to the Insurance Co, as per Indian Stamp Act or as per local Stamp Act.
