Regular appeal against the pa holder.

(Querist) 20 July 2022 This query is : Resolved 
Sir/s, The suit filed by the Plaintiff came to be decreed in the trial court. in fact, the said suit was filed through PA holder of the Plaintiff. The aggrieved defendant after lapse of 6 years he prefers an appeal against the PA holder of the Plaintiff. Whether the appeal is maintainable against the PA holder of the Plaintiff/Respondent ?

The attorney can not be sued as s/he has represented the plaintiff / principal / granter of attorney.
Accordingly an appeal against PoA is not maintainable.

Yes, appeal against power of attorney holder is not maintainable, it should have been filed against principal ( plaintiff ) whom poa has represented.
