Who has right

(Querist) 15 February 2012 This query is : Resolved 
the facts of the case as under

1.a widow has four houses of equal value
2.out of which she had bought 2 houses in the name of her 4 sons as guardian
3.she has 4 sons and 3 daughters are married
4.remaining 2 houses are in her own name
5.the property is not belong to her deceased husband
6.out of seven child s 3sons are from other person who is not legally married
7.legal husband was died in 1979
8.now the daughters who are from deceased legal husband, claiming that out of the two houses, 1 house had bought by the insured sum of deceased legal husband.
9.though it was so, today there was no proof that the house is bought by insured sum.
10.mother is alive and she dont want to give the property which is in her own name to her ungreatefull sons except to her 2 younger sons who are talking care of her by every means

can you please clarify the legal position of the daughter and the sons from the person to whom she was not legally married

Even if the house is not bought using the insured money, then also they can claim share .. illegitimate sons have absolutely no right in Shia law.. but in case of Sunni law, illegitimate children can inherit from mother and also relatives of mother

if it is proved that the property was aquired out the income of the mother, what can share that the girls can claim

are thay have an equal share

how much the property go th the mother
