406 removed

Hi,

  My wife had filed 498a/406/420 etc. The police has removed 406 from the chargesheet ( the reason could be that I had requested various times thru registered mail to collect streedhan(beds etc) from my home, nobody ever turned up. When I asked police about the same, they said wife or her family not co operating in coming to collect).

 

My question is now this : If 406 has been removed by police from the chargesheet, how much is this important if I now appeal to highcourt for quashing of case

for 498a, 420 trial is necessary.

just one section is dropped.


no. of sections is not important - its just one case

You can show it as another evidence of her lodging false complaint since she refused to collect her articles from you after being asked but has put allegation u/s406 to this effect.

You have applied for quash of the entire case (?), so mere dropping of one section from the charge sheet or FIR will not be enough for you to withdraw the quash petition, go ahead.
