441 of ipc

Do I have to give a legal notice to the person who has illegally taken the possession of my land without my consent under section 441 of ipc.
IF yes then what is the period within which I have to give that legal notice?

the possession was taken a month back

Though there's no harm, there's no use whatsoever of a Legal Notice in criminal matters.
