AJ Construction, Mumbai terrorizing Senior Citizen Couple.

This is how criminals in the garb of business people exploit tenants protected under Bombay Rent Control Act.

After a prolonged court battle tenants of a building in JB Nagar Andheri East owned by a public trust Bhagwan Das Todi Charitable Trust, Mumbai entered in to Consent Terms in the year 2013 with AJ Construction who bought the trust building in 2006.
1) As per the Consent Terms AJ Construction has agreed to provide the tenants Permanent Accomodation in the redeveloped building equal to the actual carpet area of the tenament in the old building.

2) The unscrupulous owners are deliberately delaying possession to the tenants which was fixed by the court in the year 2017-18.

3) While possession is not in site my couple friends who are senior citizens and under explit murder threats from the goons of AJ Construction for not surrendering their premises are facing yet another problem with these goons.

4) As per the Consent Terms AJ Construction is supposed to provide accomodation measuring 330 sqft Actual Carpet Area but the RERA Carpet Area of their registered flat is 334 sqft and Actual Carpet Area is only 255 sqft only.

So this is an appeal on behalf of the senior citizens to the learned lawyers in this forum to please suggest as to what legal action is possible against these goons having several cases- Civil and Criminal registered in various courts in India. TIA

If you have an order from the court in your favor you may have to file an execution petition to execute the court decree.

Believe your lawyer has done it already if so, you may have to follow it up regularly.

If the goons are threatening, then you give a complaint with the police  and after the police remains ineffective, you can approach judicial magistrate court with an application under section 156(3) cr.p.c. seeking direction to the police to initiate legal action as per law on your complaint, if that is also not effective then you can file a private criminal complaint under section 200 cr.p.c. seeking relief of action against the persons who pose threat to grab your properties under coercion or illegal means.
