Archana (Proprietress)     05 April 2015

As per hindu family law

Sir,

I am 45 years old and eldest son. We were two brothers but my brother died 4 years back with some illness.  My father has two wives. Actually I am failing to understand that who is the legal  wife. as my mothers name was already there in the Ration Card. My step mothers name was  added to ration card when I applied for new ration card after my marriage. Till then my step mother's name was not appearing in any of the ration card.  I have four step sisters. . Whatever property belonging to my father is a self earned property. He posses some agricultural land, 5 Acres NA plot given for development & almost in a ready position for industrial use approximately admeasuring  75000 sq. ft. This land is jointly in the name of we 2 brothers, my father, 3 step sisters and my step mother. another 20 Acres land is solely in the name of my father. My father is alive now. I am not aware if he has made any will.

Now the question is after my father's death what will be share of me & my mother in these above mentioned properties.

Thanks

It is believed you are Hindu.

The legal wife is ClassI legal heir.

The children are ClassI legal heir.

The first right on property of a Hindu male died without leaving a valid WILL is of ClassI legal heir(s).

Ration card is not a legal heir certificate. Your step mother & her children can also claim maintenance & share in the father's property.
