Can he surrender?

 

dear sirs,

a case was registered in 2010 of 420. there were 3 accused. two accused already got bail in 3 days in 2010. remaining one was not present. he did not appear to police coz of his repuation will be spoiled in society. police have filed the chargesheet in january 2012 declaring him as absconding. case is of only rs 22000 rs. the complaiant is ready to settle down and can give in written about the transaction. now can he surrender to court for regular bail? he dont want to get arrested even for one single minute. what can be done. he has already returned the amount of complainant via bank.he has all records.few days before he heard from one accused that some warrant has been issued against him. now what can be done? can he surrender to court? will court put him in jail or hand him over to police? someone said that once chargesheet is filed then court gives regular bail as two other accused has already got bail. dear sirs pls suggest me what can be done.

if the complaianant is ready to compromise than go for the quashing of procedings before HC (s.482)

@ rsp before going to HC u can also try for quashing of procedings before the concerned trial court as the 420 is compoundable with the persmission of court
