Cheated by brother and mother

Respected  lawyers.

I  am  living  in US for past  12  years, and   I had  sent  around  10-15 lakhs   before my marriage,  which my  mother  and  brother  said  they would  use  that  money  to buy property  ,  they  bought   one plot in  2000 for 5 lakhs   which   is  now  worth around  1  crore. 

My mom  was  needed  surgery  and  my brother  somehow  blackmailed her  and  got  the  above  mentioned plot  registered on his  name,  and  he is  building  apartment  complex  now.  

My  question  Can  I  claim  any  share in  the  above  property...as  I am legal heir  and I had  sent  them  money  in  the past..  

Can  I  go  to court  against my  brother.

U can file a case if u have proof as the same amount is utilized for purchases of plot.This is a dry legal answer!on the other side it not moral and ethical to sue the brother and mother in court.thirdly it is rather difficult to get justice in indian legal system in timeframe as there are no of ways to delay the matter,and it will be hectic for u to monitor the court procedure from US.It will be better to resolve the matter by mediation putting moral pressure on other part,legal way is last resort.

1) If you can prove what you have stated above, then you can file a declaratoty suit claiming title on the property since you had sent the consideration for buying the same,

2) You shall have to prove that the property was bought by paying from the money sent by you,

3) You can give anybody power of attorney to fight your case,

4) It will be time consuming which you should be aware right from the very begining.

HI Lawyers,

This is regarding My Mother's Proprerty.

Our Grand Mother died 4 Yrs back all of a sudden due to KIdney Failure by which there is no will for Her property. We are certain that she had cash balance in her bank account but My Mom hadnt asked granny about details of bank Acounts till she was alive, thus she has no information about which bank the amount is in and the amount in it.

Thus, we would like to know if we can find ways how we can get the details of her bank account as teh same information has been suppressed by other Legal Heirs. If yes, kindlylet us kno whow we can get this information.

Please let us know if we can take the help of RTI ACT to get better information on this regard.
